file.delete() file is in use

I have used the file.delete() method to delete some files. The function works ok on my dev computer but when deployed to the live server it complains that the file is not accessible.
Has anyone experienced this problem before? i dont think its a rights issue because after a few attempts the whole thing works fine!!
